Background

When a person dies, all of their money, assets, and possessions (known as their “estate”) are distributed in accordance with their wishes. Some people have a will in place. A will is a legal document that specifies who is in charge of carrying out the wishes of the deceased (known as the “executor”) and which persons receive what amounts/possessions of the estate (anyone who gets something is called a “beneficiary”).

In the United States, if a person does not have a will in place, then the estate is divided and distributed by the courts based on US inheritance law. Needless to say, US inheritance laws are not the same as the ones that Muslim are obligated to follow. Muslims must create Islamic wills. These vary from standard wills in the way that the estate is divided. Islamic law specifies the percentage/share of inheritance for each family member. The Quran serves as the primary source of Islamic inheritance laws, outlining guidelines that ensure a just distribution among the family members.
